Securing Your Right to Medical Leave and Reasonable Accommodations

We protect employees' rights to take protected leave and receive reasonable accommodations under the Family and Medical Leave Act (FMLA), New Jersey Family Leave Act (NJFLA), Americans with Disabilities Act (ADA), Pregnant Workers Fairness Act (PWFA), and NJLAD. These laws protect eligible employees' rights to take unpaid leave for the birth or adoption of a child, to care for family members with serious health conditions, for their own serious health conditions, and for qualifying military family exigencies, while also requiring employers to provide reasonable accommodations for disabilities, pregnancy-related conditions, and medical needs. Employers must engage in a good-faith interactive process to identify and implement appropriate accommodations and cannot interfere with, deny, or retaliate against employees for requesting or taking protected leave.
